Privacy Policy

Hummingbird may disclose your client information to the United States Trustee in connection with the United States Trustee's oversight of Hummingbird. All information gathered will be strictly safeguarded and stored in a safe manner. We will limit the mandatory collection of consumer information to the minimum required to provide necessary services, which includes performing assessments of consumers' financial situations, determining the factors which led to consumers' financial problems, assistance in preparing a budget, providing budgeting tips, performing a complete debt analysis and informing clients of the various alternatives to their financial situation without incurring a negative amortization of debt.

Information collected by Hummingbird is treated as confidential. No personally identifiable information will be released to any outside person or to any company unless required by law or expressly authorized by you or your attorney. Hummingbird will never share information with any creditor, collection agent, or credit reporting agency. Hummingbird reserves the right to collect information regarding the use of its website and program and to record telephone calls for employee training and accreditation purposes. Hummingbird promises not to sell, rent, loan, lease or trade a consumer's contact information or email address.

All Hummingbird employees are required to sign and abide by an agreement whereby they are required to keep all sensitive client information confidential.  We will permit only authorized employees, who are trained in the proper handling of client information to have access to that information. Employees who violate our Privacy Policy will be subject to disciplinary procedures.

Impact on your credit report
Hummingbird does not report any information to any credit reporting agency or bureau; therefore the use of Hummingbird's programs will have no impact on your credit report. During the course of a credit counseling session Hummingbird does provide information about alternatives based upon an individual's financial situation. Some of these alternatives, specifically debt management plans and the filing of bankruptcy, will affect your credit report. All of the financial alternatives discussed with you, including “Doing Nothing” may have an impact on your credit report.

No Contract
Consumers are in no way entering into a financial contract with Hummingbird and are not to make any contractual payments to Hummingbird. 

Source of Funding
Hummingbird's source of funding is the fees it receives for Credit Counseling certifications and Financial Education certifications needed for the purpose of Bankruptcy cases.  Hummingbird does not take or receive funding from any creditor or lender. Hummingbird's policy prohibits taking any referral fees for the referral of clients.

Instructor qualifications
Hummingbird's primary financial education instructor is Victoria Wright, who is a bankruptcy attorney, Accredited Credit Counselor and certified housing counselor. Victoria helped thousands of clients in financial distress during her 8 years of consumer practice. The secondary financial education instructors on Hummingbird's video are Jeff Strayer, financial educator for the Eastern District of North Carolina's chapter 13 bankruptcy Trustees, former employees Michael Paul and Cynthia Peacock.

Services offered in Languages Other than English
Hummingbird's services are offered in English or Spanish only. If you would like Credit Counseling or Financial Education in a language other than English or Spanish, Hummingbird will refer you to an approved agency for your language.

Approved as an agency and a provider
Bankruptcy Administrators for North Carolina and Alabama have reviewed and approved Hummingbird's credit counseling services and its personal financial management instruction services under 11 USC 111(d). The Bankruptcy Administrators have not reviewed or approved any other services that Hummingbird provides.
